Terms of Service

These Terms of Service ("Terms") govern your access to and use of Blackace (the "Service"), operated by Blackace ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Blackace is an educational blackjack tool. It tells you the mathematically correct play (hit, stand, double or split) for any hand based on perfect basic strategy, and provides explanations, statistics, hand history and practice modes to help you learn and improve. The Service is delivered entirely online and is informational and educational in nature.

2. Not gambling & no guarantee of results

Blackace is not a gambling or betting service. It does not accept wagers, does not involve real-money or virtual-money play, does not pay out winnings, and does not facilitate access to any gambling operator. It is a study and training tool.

Basic strategy reduces the house edge but does not guarantee winnings. All casino games keep a mathematical advantage for the house, and you can lose money gambling. You are solely responsible for any decisions you make while gambling and for complying with the laws that apply where you are — gambling is restricted or illegal in some places, and age limits apply. Please play responsibly. If you or someone you know may have a gambling problem, seek professional help.

3. Eligibility & accounts

You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter into a binding contract. You are responsible for the accuracy of the information you provide, for maintaining the security of your account, and for all activity under your account. Notify us promptly of any unauthorized use.

4. Free plan, Premium & billing

Blackace offers a free plan that lets you try the core features at no cost and without a payment method. A paid Premium subscription (monthly or annual — see current prices in the app) unlocks the full feature set, which may include the real-time advisor, unlimited hand history, advanced statistics, the trainer and the multi-deck rules simulator. Some features and usage may be limited on the free plan.

Paid subscriptions are charged immediately at checkout — there is no free trial — and renew automatically each billing period until cancelled. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms. Prices may exclude taxes, which are added where applicable.

5. Cancellation & refunds

You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period; you keep access until then. Except where required by law, payments are non-refundable and we do not provide refunds for partial or unused periods.

6. Content & ownership

You retain ownership of the information you enter, such as the cards and hands you submit ("Input"). The recommendations, explanations and statistics the Service produces for you ("Output") are made available for your personal use. You are responsible for how you use the Output, and you acknowledge that it is provided for educational purposes and without any guarantee of a particular result.

You grant us a worldwide, royalty-free licence to store and process your activity in the Service to operate, secure and improve it, including the strategy engine and training features. We describe how we handle your data in our Privacy Policy.

7. Acceptable use

You agree not to use the Service to:

• break the law or infringe the rights of others;
• attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
• resell or provide the Service to third parties except as expressly permitted;
• use the Service in any venue or manner where doing so is prohibited by law or by the rules of the establishment you are in.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us or other users.

8. Third-party providers

The Service relies on third parties to function, including OpenAI (used to generate explanations and coaching), Supabase (authentication, database, storage), Stripe (payments), Resend (email) and Vercel (hosting). Your use of the Service involves processing by these providers as described in our Privacy Policy.

9. Availability & changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, and may change pricing with reasonable prior notice for upcoming billing periods.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. Blackace does not provide gambling, financial, legal or other professional advice; all Output is for informational and educational purposes only, and you rely on it at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for any losses incurred through gambling or reliance on the Service, or loss of profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

12. Termination

You may stop using the Service and delete your account at any time. Deleting your account cancels your subscription and permanently removes your data as described in our Privacy Policy. We may terminate or suspend access for breach of these Terms.

13. Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. Disputes are subject to the competent courts of Portugal, without prejudice to mandatory consumer protections available to you where you live.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you (for example by email or in-app) before they take effect. Continued use after changes take effect constitutes acceptance.
